PENDAHULUAN

A. Latar Belakang

Ilmu ushul fiqih memiliki peranan yang sangat penting dalam dunia islam. Ia merupakan ibu dari segala ilmu, khususnya ilmu fiqh. Ilmu ushul fiqh menjadi dasar dalam istinbath hukum/dasar pengambilan hukum.

Pengetahuan mengani ushul fiqh sangat perlu untuk dikaji dan dipahami oleh kalangan umat islam terutama kalangan mahasiswa sperti kita agar dapat memahami secara lebih detail mengenai pembelaran ushul fiqh. Karena pada umumnya kalangan islam telah memahami ilmu fiqh tanpa banyak memperbincangkan asal istinbath hukumnya.

Pembahasan dalam ilmu ushul fiqh cukup banyak dan kompleks. Namun yang akan dibahas dalam makalah ini adalah mengenai salah satu metode istidlal, yaitu tentang maslahah al mursalah menurut konsep Najamuddin at- Thufi.
